Privacy, the GDPR implementation and competition enforcement

MEF regulatory advisor Serafino Abate examines recent privacy events in Europe where in Germany courts took action against Facebook’s practices and the EU’s first GDPR implementation report was published.

A few weeks back, we saw two different, but related, public interventions on privacy and data protection. In Germany, the Supreme Court upheld the decision by the German Federal competition enforcer, the Bundeskartellamt. To follow, the EU then published its first GDPR implementation report, two years after the seminal piece of legislation was adopted in Europe.

TIK TOK under review by European Privacy authorities

The Italian authority for Privacy (GPDP) has launched a co-ordinated action to review the risks linked with the TikTok app – an attempt to protect children’s privacy rights. TikTok is a social network that allows creating and sharing audios, videos, and pictures, used by millions of mostly young users worldwide.

The Italian DPA is calling on the European Data Protection Board (EDPB) to set up an ad-hoc task force – the EDPB it the body that represents all EU data protection authorities. The topic could have clear ramification across all international apps – currently the principles of European GDPR regulations are clear, but they are not easily applied/reviewed.

RTB advertising: ICO threatens punishments, more work to be done

Six months after its first warning the UK Privacy Regulator (ICO) is making clear that the issues with RTB online advertising have not gone away, and it is now threatening to punish companies that are misbehaving. The analysis from ICO shows that sensitive personal information is shared by some advertising players, without securing approval by users, and with few appropriate security mechanisms. ICO is happy with the progress that some have made since July 2019, but remains unsatisfied. ICO had highlighted multiple issues in the way companies exchanged user information to support online ads when landing on a webpage.

Much of the early Internet experience was based on advertising revenues, often relying on companies collecting data without clear consent from users and sharing it with a large number of advertisers and intermediaries to provide ‘better profiling’ of customers.

Brazilian Data Privacy Law is updated after latest Congress round of negotiations

Industry views: GDPR one year on

This Saturday the 25th of May marks one year since the launch of the EU’s General Data Protection Regulation which introduced new rules for how businesses handle consumer’s personal data.

We asked MEF Members from across the mobile value chain to share their thoughts on GDPR’s first year; how has the regulation impacted the mobile ecosystem and attitudes towards personal data among businesses and consumers, and what have been its major successes and failures?

“Interestingly the landscape hasn’t changed for us very much, we’ve had very strong emphasis on privacy from the very beginning, from Softbank mobile, and in order to be compliant with Japanese privacy laws, and so we built that into the product.
